Notice on issues related to working permits for foreign staff of overseas non-governmental organizations

Provinces, autonomous regions, municipalities directly under the municipality of foreign experts, Public Security Bureau, Xinjiang Production and Construction Corps foreign experts: In order to further do a good job in the management of services carried out by foreign non-governmental organizations in accordance with the law in China, in accordance with the rules on the administration of immigration to the People's Republic of China and the rules on the administration of activities within the territory of China, the foreign staff of overseas non-governmental organizations are hereby notified of the following issues when handling work permits for foreigners who want to come to China:

I. Overseas non-governmental organizations that have established representative offices in China in accordance with the law

 (1) Representative agency of foreign chief representatives. In line with foreign high-end talent standards of foreign chief representatives, the overseas non-governmental organizations representative agencies of the chief representative in China need to certify and conduct medical examinations, foreigners coming to China for work need to fill out the online work permit application form for foreigners’ Chinese work permit, the approval period can be up to 5 years.  For foreign chief representatives who are promoted to management, those with the department of the overseas non-governmental organization of the public security organ above the provincial level may also be identified as a foreign high-end talent, in accordance with the above provisions.

(2) Foreign representatives of representative bodies. Apply for a work permit online for foreigners to come to China on the basis of a representative certificate, medical certificate and application form for work permit for foreigners coming to China. In line with the foreign high-end talent standards, they should provide the corresponding supporting materials.  After the determination of their status, they could use corresponding work permit facilities. If the administrative department of an overseas non-governmental organization of a public security organ above the provincial level determines that there is a real need and obtains the representative certificate of the representative body of an overseas non-governmental organization, the age, education or work experience restriction may be relaxed as appropriate.

(3) Other expatriate staff employed on behalf of the agency according to the classification standard of foreigners working in China (for trial Implementation) and the guide to work permit service for foreigners in China (temporary) and other relevant provisions for foreigners to apply for work permit in China.

II. Temporary activities of foreign non-governmental organizations in China; filed in accordance with the law

(1) After an overseas non-governmental organization without a representative body has established a legal record for the conduct of temporary activities in the Chinese territory, the responsible overseas personnel and key staff conducting the temporary activities may rely on the provisional. The event record receipt shall handle the work permit of the foreigner in China, and the approval period of the work permit should not exceed the period of temporary activity.

(2) If a foreigner who has applied to work in China for a stay of not more than 90 days (including 90 days) comes to work in China, you should apply for a work permit online for foreigners coming to China on the basis of the provisional event record receipt. In line with the foreign high-end talent standards, you should provide the corresponding supporting materials, which can be used for the invitation letter of the provisional event record receipt online application for foreign experts coming to China.  The entourage should fill out the application form.

(3) Application for employment in China for more than 90 days, but not more than 1 years (including  the entire 1 year), by means of a record receipt, you need an employment contract or a certificate of service, a medical certificate, an online application for a foreigners’ work permit in China, a certificate of work qualification, a certificate of lack of criminal record, and the highest degree (academic degree)
